What is Application for Application for DTA sale / advance DTA sale permission

Domestic Tariff Area (DTA) Sale Permission allows eligible Export Oriented Units (EOUs) to sell a specified portion of their manufactured goods, including rejects and by-products, within India after paying the applicable customs duties and complying with the provisions of the EOU Scheme. EOUs (excluding gems and jewellery units) can generally sell goods in the DTA up to 50% of the FOB value of exports, subject to achieving the prescribed Net Foreign Exchange Earnings (NFEP). Applications for DTA sales must be submitted to the Development Commissioner, who determines the permissible sale limit and grants the required authorization. Advance DTA Sale Permission is also available for capacity expansion, product diversification, and trial production. However, this facility is not available for certain products such as motor cars, alcoholic liquor, tea (except instant tea), and books.

Who Can Apply for Application for DTA sale / advance DTA sale permission

  • Export Oriented Units (EOUs) engaged in the manufacture of goods.
  • EOUs (excluding Gems & Jewellery units) seeking to sell eligible goods in the Domestic Tariff Area (DTA).
  • EOUs that have achieved or are expected to achieve the prescribed Net Foreign Exchange Earnings (NFEP) as per the EOU Scheme.
  • EOUs undertaking capacity expansion, product diversification, or trial production and requiring Advance DTA Sale Permission.
  • Units intending to sell manufactured goods, rejects, or by-products in the Domestic Tariff Area in accordance with applicable regulations.
